Die Reform des nationalen Artenschutzrechts mit Blick auf das Urteil des EuGH v. 10.1.2006 in der Rs. C-98/03 (NuR 2006, 166)

Der Europ?ische Gerichtshof hat mit seinem Urteil vom 10.1.2006 die Bundesrepublik Deutschland wegen unzureichender Umsetzung von Art. 12 Abs. 1 lit. d sowie Art. 16 FFHRL durch § 43 Abs. 4 BNatSchG verurteilt. Damit wird nach der Caretta-Entscheidung des EuGH vom 30.1.2002 zum zweiten Mal innerhalb kurzer Zeit das System des deutschen Artenschutzrechts in Frage gestellt. Der Bundesgesetzgeber ist nun gefordert, das nationale Recht entsprechend anzupassen. Die nachfolgende Betrachtung nimmt zun?chst die Vorschrift des § 43 Abs. 4 BNatSchG in den Blick und pl?diert für deren Ausgestaltung als Abweichung im Sinn der Ausnahmeregelungen der FFH- und Vogelschutz-Richtlinie. Weiter beleuchtet sie den Vollzug des Artenschutzrechts im Rahmen der naturschutzrechtlichen Eingriffsregelung und spricht sich für eine Verankerung der Richtlinienvorgaben in § 19 BNatSchG aus.     

Verpflichtende Anrufung der Vereinsschlichtungsstelle

Die Sechsmonatsfrist des § 8 Abs 1 VerG beginnt erst dann zu laufen, wenn die anrufende Partei die erforderliche Mitwirkung an der Konstituierung der Schlichtungseinrichtung leistet. Eine Statutenbestimmung, wonach von jeder Streitpartei jeweils zwei ordentliche Vereinsmitglieder als "Schiedsrichter" zu benennen sind, die ihrerseits ein weiteres Mitglied zum Vorsitzenden zu w?hlen haben, bewirkt keine so massive Verletzung der ?quidistanz der Schlichtungseinrichtung zu beiden Streitteilen, die eine Unzumutbarkeit der Anrufung dieser Schlichtungsinstanz zur Folge h?tte. Bei einer vorschnellen Anrufung des Gerichts liegt weder eine Unzust?ndigkeit des Rechtsweges noch sachliche Unzul?ssigkeit des angerufenen Gerichtes, sondern ein Grund für die Abweisung des Klagebegehrens vor. Ein Erratum zu diesem Beitrag ist unter zu finden.     

Spectacles of military urbanism in online representations of the Elite Squad of the military police of Rio de Janeiro: a multimodal approach

This paper presents a multimodal analysis of online self-representations of the Elite Squad of the military police of Rio de Janeiro, the Special Police Operations Battalion BOPE. The analysis is placed within the wider context of a “new military urbanism”, which is evidenced in the ongoing “Pacification” of many of the city's favelas, in which BOPE plays an active interventionist as well as a symbolic role, and is a kind of solution which clearly fails to address the root causes of violence which lie in poverty and social inequality. The paper first provides a sociocultural account of BOPE's role in Rio's public security and then looks at some of the mainly visual mediated discourses the Squad employs in constructing a public image of itself as a modern and efficient, yet at the same time “magical” police force.     

Paternity Testing Commission of the International Society of Forensic Genetics: recommendations on genetic investigations in paternity cases

The International Society for Forensic Genetics (ISFG) has established a Paternity Testing Commission (PTC) with the purpose of formulating international recommendations concerning genetic investigations in paternity testing. The PTC recommends that paternity testing be performed in accordance with the ISO 17025 standards. The ISO 17025 standards are general standards for testing laboratories and the PTC offers explanations and recommendations concerning selected areas of special importance to paternity testing.     

DNA commission of the International Society of Forensic Genetics: Recommendations on the interpretation of mixtures

The DNA commission of the International Society of Forensic Genetics (ISFG) was convened at the 21st congress of the International Society for Forensic Genetics held between 13 and 17 September in the Azores, Portugal. The purpose of the group was to agree on guidelines to encourage best practice that can be universally applied to assist with mixture interpretation. In addition the commission was tasked to provide guidance on low copy number (LCN) reporting. Our discussions have highlighted a significant need for continuing education and research into this area. We have attempted to present a consensus from experts but to be practical we do not claim to have conveyed a clear vision in every respect in this difficult subject. For this reason, we propose to allow a period of time for feedback and reflection by the scientific community. Then the DNA commission will meet again to consider further recommendations.     

Additional variability at the D12S391 STR locus in an Austrian population sample: sequencing data and allele distribution

The highly polymorphic STR locus D12S391 was investigated in an Austrian population sample (N=150) by PCR-amplification, comparative detection on native and denaturing polyacrylamide gels and solid phase single stranded sequencing of three size variant alleles and several additional alleles. A total of 15 alleles, distinguishable by size under denaturing conditions, could be detected. No deviations from Hardy-Weinberg equilibrium were observed in the population investigated (P=0.52). Sequencing of size variants designated 17.3 and 18.3 showed an incomplete (GAT) repeat unit at position two of the tandem region. Additional new sequence variants due to varying compositions of the number of (AGAT) and (AGAC) repeats could be identified. Due to distinct electrophoretical mobilities of alleles of the same size but different sequence structures, denaturing detection conditions should be employed when the aim is standardization.
